1. Our approach
Tunely respects the intellectual property rights of others and expects its users to do the same.
If you believe that content available through Tunely infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act, 17 U.S.C. § 512, to our designated copyright agent.
2. DMCA takedown notices
A valid notice should include:
- Identification of the copyrighted work you believe has been infringed, or a representative list if multiple works on Tunely are covered by the notice
- Identification of the material you believe is infringing, including enough information for us to locate it
- Your name, mailing address, telephone number, and email address
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed
- Your physical or electronic signature
We respond expeditiously to notices that substantially comply with these requirements by removing or disabling access to the material identified in the notice. We take reasonable steps to promptly notify the user who submitted the material. If a notice identifies the work and material and provides contact information but is otherwise incomplete, we will contact the sender or take other reasonable steps to help obtain the missing information.

4. Counter-notifications
If you believe material you submitted was removed or disabled as a result of a mistake or misidentification, you may send us a counter-notification containing:
- Identification of the material that was removed or disabled and where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification
- Your name, address, and telephone number
- A statement consenting to the jurisdiction of the U.S. federal district court for the judicial district where your address is located, or, if your address is outside the United States, any judicial district in which Tunely may be found, and agreeing to accept service of process from the person who submitted the original DMCA notice or their agent
- Your physical or electronic signature
Counter-notifications should be sent to the Copyright Agent listed above.
Upon receiving a valid counter-notification, we promptly forward a copy, including your contact information, to the person who submitted the original notice and inform them that we will restore the material in 10 business days. We restore the material no sooner than 10 and no later than 14 business days after receiving the counter-notification, unless our Copyright Agent first receives notice that the original complainant has filed a court action seeking to restrain you from infringing activity relating to the material.
5. Repeat infringers
Tunely terminates the accounts of repeat copyright infringers in appropriate circumstances. We may also suspend accounts or restrict access while reviewing copyright complaints. We consider copyright notices and other evidence of infringement, including relevant counter-notifications, when deciding what action is appropriate.
